Terms of service
Please look through the following terms of service.
The "terms of service" (hereinafter referred to as "TOS") specifies terms and conditions for this site and service which Sky Origin Inc.(hereinafter referred to as "Company"). Therefore, TOS is a lawful and valid contract between customers and Company. Your use of the site and service is deemed to be considered on the basis that you have agreed on all the terms and conditions of TOS. We regret to inform that you may not use the web site and service if you do not agree on TOS. Additionally, this web site has links with other sites operated by affiliates of Company. When you use such web sites, please be advised that you need to agree on the terms of service and stipulations thereon.
Article 1(Definition)
The terms used in this TOS have the following meanings.
(1)"TOS, etc." collectively means this TOS, notices for use of this site, the other stipulations, guidelines, etc. set up by Company.
(2)"Site User" or "User" means an individual who uses this site and service with agreeing on TOS.
(3)"Services" means all the services, which Company offers, regardless whether charged or free, on those web sites, which Company operates, including J-goods’ web site.
(4)"User Data" means the information relating to attributes which User discloses to Company and tracked records and so on relating to use of the site and service.
(5)"Service Provider" means the person who provides any site operated by a third party other than Company and Company's partners, including an internet shop operated by a third party who is introduced on the site, and products, roles, or services dealt therein.
Article 2(User)
1.User may use each Service on the site with acceding on TOS and complying there with. Additionally, some Services require membership registration or registration of the information relating to User attribute.
2.User may not dispose all the rights which you acquired through assignment, sublease, hypothecation and other means regardless of modes.
Article 3(The TOS)
The TOS is applied to any User. Every User must comply with TOS when using the site and Services.
Article 4(User date)
1.If any changes occur in registered User's data, User is responsible to change it. The company shall not bear any responsibility for the damage occurred if such changes are not duly carried out.
2. Regardless of the overwriting of old data with new, we shall handle Services based upon the previous data in cases of overwriting done after procedure, application and settlement.
Article 5(Trade)
1.Even when a User purchases products by way of, or by using our services, the deal shall be deemed to be a direct trade between the User and the merchant (distributor). Regarding products, which Company does not retail (products purchased thru sub-agent), Company shall not be the party concerned and shall not take any responsibility for the deal. Furthermore, the user shall take full responsibility for whole of the deal.
2.The Services provided by Company is absolutely representative services for User to purchase products; therefore, Company shall not be deemed to be a merchant (except as to the products retailed by Company).
3. At the point a User made his/her 1st payment, the User is regarded as the customer entrusted J-goods with purchasing the item the User needs. The User must not protest against J-goods.
Article 6(Exemption from responsibility of the company)
1. Company will not insure the accuracy, exactness, usability, reliability, legitimacy, sustainability of the merchant (distributor); it is Users’ duty to ascertain the truth.
2. Company will not take any responsibility for failure out of the company's management or unpredictable disturbance, and interference, suspension and data elimination, which occurred thereby; harm and damage occurred by unauthorized access; and damage regarding use of Services of Company.
3. Company will not guarantee if harmful computer virus is included in the mails and contents sent from the site, servers, domains, and so on through Company and the Services provided by Company.
4. Company may sometimes provide information and give advice to User(s) and Service Providers; however, Company will not take responsibility thereby.
5. Company will not take any responsibility regarding any damages occurred on User(s) due to their violation of TOS.
Article 7(Prohibited matter)
The following conducts are forbidden when User(s) use the site and Services:
(1)Any conduct which violates laws, regulations, TOS, or notices for use of this site and other TOS, etc., or actions which could lead to such conduct.
(2)Any conduct which damages right, credit, interest and so on of Company and any third party, or actions which could lead to such conduct.
(3)Any conduct which attempt unauthorized access to Company's server or other computers, or actions which could lead to such conduct.
(4)Any conduct which resale the products purchased through the site and Services to other persons, or actions which could lead to such conduct.
(5)Any conduct which cause trouble or bring discomfort to other people, or actions which could lead to such conduct.
(6)Any conduct which send or write harmful computer programs, mails or so on to/on the site, or actions which could lead to such conduct.
(7)Any conduct which report or record false information, including registration of false information.
(8)Any conduct which is offensive to public order and morals, or actions which could lead to such conduct.
(9)Other conducts which Company determines to be inappropriate.
Article 8(Access data)
1. Company may collect data regarding IP address accessed to Company's server, data regarding identification of terminals, and data regarding access records, etc. by utilizing cookies technology and other technologies, for the purposes of certification of Users' access to the site, surveillance of popularity, and provision of the best suited service.
2.If User(s) set configuration to deny the previous paragraph, they may not use the Services.
Article 9(User data)
1. Company appropriately manages user personal data according to Company's privacy policy.
2. Company will not disclose User Data to any third party in principle without previous consent.
However, in the cases of any of the following events, the aforesaid remark is not applicable;
(1)When Company is required to disclose such information under laws and regulations.
(2)When Company conducts business in cooperation with Company's affiliates. In this case, Company will request them to handle User Data appropriately.
(3)When Company determines that it is necessary to protect interest, credit, right or so on of Company, Users of the Services, and Service Providers.
3. Company may use User Data in order to provide Services to User, to facilitate use of Services, to improve contents of Services, and to conduct smooth operation of Services.
4. Company may provide information to User by mail magazines, advertisement and other means. If User does not want such information, Company will stop providing. Company may not stop providing the information, however, when Company determines the information to be necessary for operation of Services, despite Users’ wishes.
Article 10(Use of service)
Services of J-goods shall be usable only when User agrees on TOS and all written article which is on our web site.
Article 11(Interruption and stop, etc. of service)
Company may sometimes carry out periodical or emergency maintenance in order to let User utilizes Services comfortably. Additionally, the company shall be able to take actions such as delay or suspend all or any portion of Services without prior notice in the case when we determines that load concentrate on system servers of Company or any trouble could occur for service operation; when there arises a need to ensure security for User; or other cases when Company determines there is a need to take such actions. Regarding any damage, which may occur by such actions on User, we will not bear any responsibility.
Article 12(Suspension of specific user)
If Company determines User falls under any of the following cases, it may suspend Services for such User, reject to accept registration of such User, eliminate registration of such User, and so on without prior notice. Even if any damage rises on such User, we will not bear any responsibility.
(1)User violates law, TOS, etc..
(2)There is a need to ensure security of User(s).
(3)There is a fraudulent act on use of Service(s).
(4)Other cases when Company determines there is a need.
Article 13(Change and abolition of service)
Company may change or abolish all or any of Service at its determination from time to time.
Article 14(Revision of the TOS)
Company may amend and supply TOS, etc. at its discretion. Amendment of or supplement with TOS shall take effect at the time when we presents amended or supplied TOS on the site. In this case, members and Users must comply with the amended or supplied TOS.
Article 15(Conforming method/ Mutual agreement jurisdiction)
The TOS shall be construed and interpreted under the laws of Japan. If there is a need of any lawsuit hereunder, Nagoya district court of Japan shall be the agreed exclusive jurisdiction for first trial.
Article 16(English version of TOS )
This English TOS is just translation of Japanese TOS. All apply to Japanese TOS.
